Terms of use
Last updated: · Version 0.1
This is a translation for convenience. If it differs from the Spanish version, the Spanish version prevails. Español
These are the terms for using RefMe, the iPhone app that finds the clothes in TikTok videos, Instagram Reels and YouTube Shorts, and tells you where to buy them. We’ve written them to be clear on first reading. If anything isn’t, email us at [pending: support email].
In short. This summary is just to help you find your way: what counts is the full terms.
- Seeing what someone is wearing in a video or photo is free. So is finding where to buy it, up to 5 items a week.
- AI can get things wrong, and prices are set by the shops: always check with the shop before you buy.
- We don’t sell anything, and shops don’t pay us. Whatever you buy, you buy from the shop.
- Use the app for yourself, respecting the people who make the videos and anyone who appears in your photos.
- You can delete your account from the app whenever you like. If you ever pay for Pro, the subscription is cancelled separately, in your Apple Account.
Who we are
RefMe is a service provided by [pending: owner name or company name] ([pending: legal form]), with tax ID [pending: tax ID (NIF)] and registered address at [pending: registered address]. In these terms, “we” and “us” means [pending: owner name or company name], and “you” means the person using the app.
You can reach us at [pending: contact email]. Our other details are in the legal notice.
What these terms cover
These terms are the contract between you and us for using RefMe: the app and the service behind it (analysing videos and photos, searching shops, your wardrobe and, once it exists, the Pro subscription).
You need an account to use the app. By creating one, you accept these terms. If you don’t agree with them, please don’t create an account.
Your licence to install and use the app on your iPhone comes from Apple’s Licensed Application End User License Agreement (“Apple’s EULA”), which you accept when you download the app from the App Store. These terms add to it. If they ever conflict, the following apply, in this order:
- the Apple’s terms section of these terms;
- the rest of these terms;
- Apple’s EULA, as regards the licence for the app.
How we handle your personal data is explained in our privacy policy. We recommend reading it: it’s part of how the service works.
Before you create an account
This is what the law (Article 27 of Spain’s Information Society Services Act, LSSI) requires us to tell you before you enter into the contract, and how it works in the app:
- The steps. Download the app from the App Store — it’s free. On the sign-up screen, enter your email and a password of at least 8 characters, then tap “Crear cuenta” (Create account). Right below the button are the links to these terms and to the privacy policy. As soon as your account is created, you’re in.
- Fixing mistakes. Before you tap “Crear cuenta”, you can review and change what you’ve typed, and see your password with the eye icon. If the email isn’t valid or the password is too short, the app tells you before sending anything. If you spot a mistake in your details later, email us and we’ll correct it.
- Buying Pro, once it’s available: the purchase is handled by Apple’s payment sheet, which shows you the price and the period before you pay and asks you to confirm. If you close it without confirming, you pay nothing. Apple emails you the receipt.
- Languages. You can read these terms in Spanish and in English; the app itself is currently only in Spanish. The contract is concluded in Spanish and, if the two versions differ, the Spanish one prevails.
- Where the contract is kept. We don’t file a separate copy of each person’s contract. The current version is always on this page, with its number and date, and the change history is at the end. If you need an earlier version, ask us and we’ll send it to you.
Who can use the app
- You must be at least 14 years old. If we find that an account belongs to someone under that age, we’ll delete it.
- If you’re under 18, you can use the free plan, but you need your parents’ or guardians’ permission to pay for Pro. With Apple’s Family Sharing, they can require their approval for every purchase.
- Your details must be accurate, and the email address must be yours.
- Your account is personal: one person per account. Don’t share it, sell it or hand it over to anyone.
- Look after your password. Don’t tell it to anyone. If you think someone has got into your account, change it and email us.
What the app does
RefMe helps you find the clothes you see in videos and photos:
- You share a video link with the app (or paste it), or pick a photo or screenshot from your library.
- We analyse the video or image and show you the items we’ve found. If the caption or the public comments say which shop something is from, we show you that too.
- You choose which items to search for, and we look for similar products in online shops using Google Lens image search, which we access through our provider, SearchAPI.
- We show you links to those shops, with the price when the shop provides it, and you can save what you like to your wardrobe and to collections.
What content it works with
- TikTok: videos and photo carousels.
- Instagram: Reels and posts.
- YouTube: Shorts only, not regular videos.
- Your photos and screenshots, from your library.
It only works with public content. It doesn’t work with private accounts, deleted content or content the platform restricts (by age or country, for example).
What to know about the results
- AI can get things wrong. Items are recognised by another company’s artificial intelligence model (currently Claude, by Anthropic). It may miss an item, mistake its type or colour, or describe it poorly. For now it recognises clothing only: accessories such as shoes, bags or jewellery aren’t detected.
- These are similar products, not always the exact item. Results come from Google Lens, which searches by image, and appear in the order it returns them. If the caption or the comments say which shop an item is from, that shop’s products move to the top and are marked. Comments are written by other people, and we don’t check them.
- Prices and availability are only a guide. They come from Google and the shops, may be out of date or wrong, and there isn’t always a price. What counts is what the shop says when you buy.
- We don’t identify anyone. The app recognises clothes, not people: it doesn’t use facial recognition or try to work out who appears in a video or photo.
We’re not a shop
We don’t sell products or take part in the purchase. When you tap a result, the shop’s website opens in a browser sheet inside the app. Whatever you buy there, you buy from the shop, under its own terms of sale, delivery and returns, and its own privacy policy.
Right now we earn nothing from those links: they aren’t affiliate links, and no shop pays us to appear or for its position in the results. If that changes, we’ll say so clearly in the app and in these terms before it happens.
Not affiliated with the platforms
RefMe is an independent app. We are not affiliated with TikTok or ByteDance, Instagram or Meta, YouTube or Google, or Apple, and none of them sponsors or endorses the app. Their names and trademarks belong to their owners: we only use them to tell you what the app works with.
The content you analyse
Other people’s videos and posts
The videos and posts you analyse belong to the people who created them. Analysing one gives you no rights over it. The app shows you frames and cut-outs only so you can see the items and search for them: it isn’t for downloading, saving or reposting anyone’s videos. The service is for your personal, non-commercial use.
To analyse a link, our server requests the content from the platform, just as anyone would see it on its website. We keep the selected frames, the cut-outs of the items, the title or caption, the @ of the account that posted it and, when the platform shows them, the public comments we use for hints. If someone else analyses the same video later, we reuse that analysis: it’s faster, and nobody can see who asked for it before. What we keep and for how long is explained in the privacy policy.
Your photos and screenshots
When you upload a photo or screenshot, you confirm that you have the right to use it in this way and that, if someone recognisable appears in it, you aren’t infringing their rights (for example, because they’ve given you permission). Don’t upload:
- illegal content;
- intimate or sexual images, of yourself or anyone else;
- images of minors in intimate, sexualised or compromising situations;
- images that harass or humiliate people, or incite hatred or violence.
If we see signs of child sexual abuse, or of a crime that threatens someone’s life or safety, we’ll report it to the authorities.
We don’t keep the original file of your photo: we process it and keep a reduced copy, without location or camera data, along with the cut-outs of the items.
The permission you give us
Your photos remain yours. For the service to work, you give us a free, non-exclusive permission (a licence), limited to what’s needed to:
- process them and send them to the providers that recognise the clothes and search the shops, as explained in the privacy policy;
- store the reduced copy and the cut-outs, and show you the results in the app;
- reuse the analysis only with someone who uploads exactly the same file, identical byte for byte. That person won’t know you uploaded it.
This permission lasts as long as we keep the photo. If you delete your account, we delete the copies of your photos and their analyses, except those still in use by someone else because they uploaded the same file. You can also ask us to delete a specific photo (how to ask). We don’t use your photos for advertising or to train artificial intelligence models, and we don’t publish them.
Moderation
We don’t review what you analyse in advance, and we don’t use automated systems to moderate content: the app’s artificial intelligence only recognises clothes. If someone reports content to us, or we spot it ourselves, a person reviews it.
We may remove an analysis, a photo or a cut-out, or restrict your account, if the content is illegal or breaks these terms. If we do, we’ll tell you what we’ve decided, the facts it’s based on, which law or part of these terms justifies it, and how you can appeal: by replying to our email so that we review it again. You can also go to the courts.
What’s not allowed
You may not:
- use the app as a video downloader or to extract content from TikTok, Instagram or YouTube;
- use bots, scripts or any automated system with the app, call our server from outside the app, or extract data in bulk (scraping);
- get around the service’s limits, for example by creating several accounts or tampering with the app;
- copy, decompile or reverse-engineer the app or the server, except where the law expressly allows you to;
- resell the service or its results, or use them for commercial purposes;
- infringe the rights of the people who make the videos or of anyone else, for example by reposting their content without permission;
- use the app to harass, monitor or single anyone out;
- try to access what you’re not allowed to, overload the service, or introduce viruses or malicious code;
- use it for anything illegal.
If you do, we may restrict or close your account, as explained in Suspension and account closure.
The free plan and its limits
The app is free. Here’s what’s included:
| What | On the free plan |
|---|---|
| Seeing which items are in a video or photo | Free, uses nothing |
| Searching shops for an item | 5 items a week |
| Reopening an item you’ve already searched for | Uses nothing |
| Saving to your wardrobe and collections | Free |
| Starting new analyses | Up to 20 every 24 hours |
How the week works. Your week starts when you search for your first item: from then on, you have 7 days to use your 5 searches. When the 7 days are up, they all come back at once, and your next week starts the next time you search. The app shows you how many you have left and when they come back.
What uses a search. The first time you search for an item, it uses one, even if someone else had already searched for it. Going back to one you’ve already searched for doesn’t. If you choose more items than you have left, none are searched and the app lets you choose fewer.
New analyses. So that nobody uses the app as a download service, you can start up to 20 new analyses every 24 hours. Videos that someone else had already analysed don’t count. We also briefly hold back anyone sending lots of analyses within the same minute. This limit is the same on every plan.
Temporary limits. At times of very high demand, if our providers’ costs spike, or if one of them fails, we may pause or limit searches or analyses for a while. The app will tell you.
If we change the numbers. We may change these limits. If we lower them, we’ll tell you in the app before the change applies.
The Pro subscription
Pro isn’t on sale yet. When it is, what we explain here will apply, and the app will show you these conditions before you buy.
What it will include
With Pro you’ll be able to search shops for items without the free plan’s weekly limit. To prevent abuse (bots, reselling or shared accounts) there will be a fair-use cap, designed so that anyone using the app for themselves won’t notice it. If it’s reached, searches will pause until there’s room again, and the app will tell you when. The limit on new analyses every 24 hours will be the same as on the free plan.
Price and payment
- The price will be the one shown in the app and on Apple’s payment sheet before you buy, taxes included. It may vary by country.
- Apple will charge it to the payment method on your Apple Account. We don’t see or store your payment details.
- If there’s ever a free trial, we’ll tell you beforehand how long it lasts and when billing starts.
Renewal and cancellation
- Pro will be an auto-renewing subscription: at the end of each period it renews for another period of the same length, unless you cancel at least 24 hours before it ends.
- The renewal is charged within the 24 hours before the end of the period.
- You can view and cancel your subscription on your iPhone in Settings > your name > Subscriptions. If you cancel, you keep Pro until the end of the period you’ve already paid for. After that, your account goes back to the free plan and you don’t lose anything in your wardrobe.
- Deleting your account doesn’t cancel the subscription. Cancel it first in Settings, or Apple will keep charging you.
Price changes
If we change the price, Apple will let you know before charging you the new one. If it goes up, Apple may ask you to accept it, under its own terms; if you don’t, the subscription will end at the end of the period you’ve already paid for.
Refunds and restoring purchases
- Refunds are handled by Apple: you can request one at reportaproblem.apple.com. We can’t issue them ourselves, because we have no access to payments.
- If you change iPhone or reinstall the app, sign in to your account and tap “Restaurar” (Restore) on the Pro screen to get your subscription back.
Withdrawal and legal guarantee
Right of withdrawal
If you’re a consumer, you can withdraw from your Pro purchase within 14 calendar days without giving a reason (Articles 102 to 108 of Spain’s General Law for the Protection of Consumers and Users, TRLGDCU). On the App Store, the subscription is sold to you by Apple, so you exercise this right with Apple, under its terms: at reportaproblem.apple.com, by requesting a refund for that purchase. If you have any trouble doing so, email us at [pending: support email] and we’ll help.
The free plan doesn’t need a right of withdrawal: you can stop using it and delete your account whenever you like.
Legal guarantee
The app and Pro must work as we describe in these terms and in the app. If they don’t, you have the rights given by the legal guarantee of conformity for digital content and services (Articles 114 onwards of the TRLGDCU): to ask us to fix it free of charge within a reasonable time and, if that isn’t possible or we don’t do it, to get a price reduction or end the contract. As Pro is supplied continuously, we’re liable for any lack of conformity that appears while your subscription lasts.
Email us first at [pending: support email]. If you’re owed money back, it’s done through Apple.
Availability and changes
We work to keep the app running well at all times, but it depends on things we don’t control:
- TikTok, Instagram and YouTube may change their websites or block access to their content. Some links may then stop working, entirely or for a while.
- The providers we use, such as our artificial intelligence or search provider, may fail or change their terms.
- Sometimes we’ll need to pause the service briefly to maintain or fix it.
We may improve the app, change how it works or remove features. Some updates may be needed to keep using it. We’ll provide security updates, and those needed for the app to keep working as described, for as long as we offer the service.
If you pay for Pro and a change affects you negatively in a significant way, we’ll tell you clearly and in advance, and you’ll be able to cancel free of charge within 30 days of the notice or of the change.
If we ever decide to close the service, we’ll give you at least 30 days’ notice, and you’ll be able to ask us for a copy of your data before it closes.
Intellectual property
The app, its design, illustrations, text and code, and the RefMe brand, belong to us or to those who have licensed them to us, and are protected by intellectual and industrial property laws. These terms give you no more rights over them than those needed to use the app as provided for in Apple’s licence and these terms.
Third-party content you see in the app (videos, frames, product photos, and the names and trademarks of shops and platforms) belongs to its owners. Product images are loaded directly from Google or from the shops.
If you send us ideas or suggestions, we may use them to improve the app without owing you anything for them.
Our liability
We’re responsible for providing the service as described in these terms and, as provided by law, for any damage we cause you by failing to do so.
We’re not responsible for:
- what you buy from a shop: the product, its price, delivery, returns or any problem with the shop are a matter between you and the shop. Before buying, check that the shop is trustworthy and read its terms;
- a result not being the exact item, or a price not matching the shop’s: the app looks for similar products, and prices are set by the shops;
- third-party content (videos, comments or shop websites) or what it says;
- interruptions due to causes beyond our control, such as platform changes or blocks, provider or internet failures, or force majeure;
- use of the app that breaks these terms.
None of this limits our liability for wilful misconduct or gross negligence, or for harm to life or health, nor the rights you have by law as a consumer that can’t be excluded by contract.
You’re responsible, as provided by law, for any damage you cause by using the app in breach of these terms; for example, if you upload content that infringes someone else’s rights.
Suspension and account closure
If you want to leave
You can stop using the app and delete your account whenever you like, from the settings in the app itself (step by step). Deleting your account can’t be undone. What’s deleted and what’s kept, with nothing that identifies you, is explained in the privacy policy.
Remember: deleting your account doesn’t cancel Pro. Cancel it first in Settings > your name > Subscriptions.
If you can’t sign in to the app, email us at [pending: support email] from the address linked to your account, and we’ll delete it within 30 days at most.
If we have to suspend your account
We may restrict features, or suspend or close your account, if you break these terms seriously or repeatedly, if the law requires us to, or if there’s a real risk to the security of the service or of other people. We’ll act proportionately: depending on the case, we’ll warn you first or restrict only what’s necessary.
We’ll tell you what we’ve decided and why, unless the law or an authority prevents us from doing so, and you’ll be able to reply to that email to ask us to review it. A person will review it.
If we close your account without you having broken these terms, we’ll give you advance notice and, if you pay for Pro, you’ll be entitled to the appropriate refund for the part you couldn’t use.
Illegal content and takedowns
If you think something in the app is illegal or infringes your rights (for example, because you made a video that’s been analysed, you appear in an image, or it’s your trademark), let us know. Anyone can do this, whether or not they use the app. We explain how in Report content.
For us to act, your notice must include (Article 16 of the EU Digital Services Act):
- the exact link or the analysis ID;
- why you believe it’s illegal or infringes your rights;
- your name and email address, unless it concerns child sexual abuse;
- a statement that, in good faith, what you’re telling us is accurate and complete.
We’ll confirm that we’ve received it, a person will review it diligently and objectively, and we’ll tell you what we’ve decided and how to appeal. We don’t use automated systems to decide on these notices.
If you made a video or appear in one and want us to remove its analysis even though it isn’t illegal, write to us anyway: we’ll treat it as you exercising your right to object (explained in the privacy policy).
Changes to these terms
We may change these terms to adapt them to the law or to changes in the service, or to explain them better. If the change is significant, we’ll let you know in the app or by email at least 30 days in advance, and tell you what’s changing.
If you don’t agree, you can stop using the app and delete your account before the change applies (and, if you pay for Pro, cancel it). If a change works against you, the Pro period you’ve already paid for continues under the previous terms.
Each version has a number and a date. You’ll find them all in the change history at the end of this page.
Governing law and complaints
These terms are governed by Spanish law. If you’re a consumer living in another European Union country, you keep the protection given to you by the mandatory rules of your country (Article 6 of the Rome I Regulation).
If you’re a consumer, you can bring a claim before the courts where you live, and we can only bring a claim against you before those courts.
First of all, email us at [pending: contact email]: almost everything can be sorted out that way.
- Official complaint forms. Official complaint forms (hojas de reclamación) are available to you under the consumer regulations of [pending: Spanish region (autonomous community)]. Ask us for them by email.
- Alternative dispute resolution. [pending: whether we adhere to an alternative consumer dispute resolution body, such as the Consumer Arbitration Board, and which one]
- Consumer services. You can also contact the consumer protection services in your region or your local council.
Apple’s terms
Apple requires these terms for apps on the App Store. If anything in the rest of these terms contradicts them, these prevail.
- The agreement is between you and us, not with Apple. We, and not Apple, are solely responsible for the app and its content.
- Licence. Your licence to use the app is non-transferable and lets you use it on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. It may also be used by other accounts linked to yours through Family Sharing or volume purchasing.
- Maintenance and support. We are solely responsible for providing maintenance and support for the app (support). Apple has no obligation whatsoever to do so.
- Warranty. We are solely responsible for any warranties for the app, whether provided by law or by contract, to the extent they haven’t been validly disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
- Claims about the app. We, and not Apple, will address any claims by you or a third party relating to the app or your use of it, including: product liability claims; any claim that the app fails to meet an applicable legal or regulatory requirement; and claims arising under consumer protection, privacy or similar legislation.
- Intellectual property. If a third party claims that the app, or your possession and use of it, infringes their intellectual property rights, we, and not Apple, will be solely responsible for investigating, defending, settling and discharging that claim.
- Legal compliance. You represent that you are not located in a country subject to a US Government embargo or designated by the US Government as a “terrorist supporting” country, and that you are not listed on any US Government list of prohibited or restricted parties.
- Who to contact. For any questions, complaints or claims about the app: [pending: owner name or company name], [pending: registered address], [pending: contact email].
- Third-party terms. When using the app, you must comply with any applicable third-party terms, such as those of your mobile or internet provider.
- Apple as third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms. When you accept them, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
Nothing in this section limits your statutory rights as a consumer.
Languages and contact
These terms are available in Spanish and English. If the two versions differ, the Spanish version prevails.
For questions about the app, email [pending: support email] or visit the support page. For your personal data, email [pending: privacy email]. For anything else, [pending: contact email]. Our address is [pending: registered address], and our other details are in the legal notice.
